GENERAL CONDITIONS OF SALE

PREAMBLE :

The online store of the www.lafarigoule.webtekdemo.com site (the “Site”) has been set up and is operated by the company Superdietetic, a simplified joint-stock company with capital of €72,000, whose registered office is located at Rue du Vieux Collège, 06500 Menton, registered in the Nice Trade and Companies Register under number 307 498 584, including intra-community VAT number FR5930749858400019 (hereinafter “La Farigoule”).

ARTICLE 1: OBJECT

The following provisions define the general conditions of sale (“GTC”) of the products offered on the online store www.lafarigoule.webtekdemo.com (the “Site”). Any order placed via the Site with La Farigoule by any natural person (the “Customer”) requires prior consultation of these general conditions of sale by the Customer. Consequently, the Customer acknowledges being fully informed of the content of these general conditions and gives his prior and unreserved agreement to the GCS insofar as the Customer ticks the box “I accept the general conditions of sale” and validates his order. The Customer is deemed to have the legal capacity necessary to place an order and La Farigoule may not be required to verify the legal capacity of each Customer.

The T&Cs set out below protect La Farigoule as well as the Customer against any claim or complaint. Any request that does not comply with the GCS cannot be accepted without our written agreement. La Farigoule reserves the right to change the General Conditions at any time, subject to displaying these changes on its site. The version of the GCS applicable to any order being that appearing on the Site at the time of validation of the order.

ARTICLE 2: PRODUCTS

The Products offered for sale are those described on the Site on the day the Customer consults the Site, within the limits of available stocks. La Farigoule reserves the right to modify its range of Products at any time. The photos of the Products presented on the Site are not contractual. However, La Farigoule takes particular care to ensure that the photos and description are as accurate as possible. However, it is possible that errors may appear on the Site, which the Customer acknowledges and accepts.

ARTICLE 3: ORDER

Taking an Order on the Site includes several stages during which the Customer may modify the content of his order leading to the validation of the Order. From the moment the Customer validates his order, he is considered to have accepted the content and conditions of the order and in particular these GCS, the price, the quantities and the delivery costs.

Orders via the Internet are reserved for individuals and natural persons within the framework of the normal needs of a household.

All orders can be processed within the limits of available stocks. In the event that, despite our vigilance, an item becomes temporarily unavailable, the customer will then be notified of the breakdown of the product by a written message via e-mail or telephone. The sending of the article being compromised, the customer will then have the choice between a replacement for equal or lower amount or a refunding of the broken product.

ARTICLE 4: PRICE AND TERMS OF PAYMENT

The prices indicated on the Site are in Euros, all taxes included, excluding postage and customs fees. La Farigoule reserves the right to change the price of any of the products offered for sale without notice. In the event of a price change on an order being processed, the price applied to the customer will be that which was displayed at the time of purchase. However, in more important cases such as input errors, we reserve the right to cancel a sale.

The Products are payable in cash upon validation of the order. Payment for purchases is made either securely by credit card, or via Paypal, or by bank transfer or possibly by check (France only).

In the event of reimbursement, La Farigoule will reimburse the Customer via the payment method chosen when placing the order, no later than 14 days after the cancellation of the order.

ARTICLE 5: DELIVERIES:

Deliveries in France are generally provided by La Poste or its subsidiary DPD, from Monday to Saturday. The delivery or transfer of risks means when the Customer takes physical possession of the Products.

The usual (non-contractual) delivery times are indicated when the Customer chooses the delivery method when finalizing his order. In order for these deadlines to be respected, the Customer must ensure that he has communicated exact and complete information concerning the Delivery address (street number, building number, staircase number, access code, intercom names, etc. ,…) as well as his mobile phone number, used by the carrier to fix a delivery slot and if necessary during the delivery itself (digicode not indicated in the order, address requiring clarification, etc.). La Farigoule cannot be held responsible for the delay in delivery not being its fault, in particular in the event of incomplete delivery information, or justified in the event of force majeure (strikes, accidents, riots, fire, etc.) ).

The maximum delivery time is 30 working days from the confirmation of the order. In the event of late delivery (delivery exceeding 30 days), the Customer may order La Farigoule to deliver within a reasonable additional period. If La Farigoule has not complied within this period, the Customer has the right to cancel his order unless the delay is attributable to force majeure.

For deliveries by La Poste, the package is delivered by hand against signature to the recipient, or to the person living with him, or to a specially authorized person. The digitized signature is proof of delivery of the package.

In the event of the absence of the recipient at the address indicated, a notice of pending is left by La Poste in the mailbox of the recipient, who can collect his package from the post office indicated within 14 calendar days. .

Packages not collected by their recipient within the time indicated are returned to our warehouse, and the return costs are then invoiced to the Customer. At the Customer’s choice, the undelivered products are then either refunded to the Customer or reshipped.

For deliveries made by DPD, a subsidiary of La Poste, the carrier contacts the recipient by SMS and/or email to set the delivery window, using the mobile phone number provided when ordering. If no mobile phone number was indicated when ordering this service cannot take place. The package is delivered by hand against signature to the recipient, or to the person living with him, or to a specially authorized person. The digitized signature is proof of delivery of the package.

In the event of the recipient’s absence at the address indicated, a notice of pending is left by DPD in the recipient’s letterbox, who can contact the DPD branch for a new delivery or collect their package from the branch. indicated within 10 working days. Packages not collected by their recipient or delivered within the time indicated are returned to our warehouse, and the return costs are then invoiced to the Customer. At the Customer’s choice, the undelivered products are then either refunded to the Customer or reshipped.

For deliveries to a DPD pick-up point (Relay Pick-Up), the day the parcel arrives at the Pick-up Relay, the recipient is notified by text message and/or email. In addition to the package number, an identity document will be requested from the recipient when collecting their package at the Relais Pickup. If the withdrawal is made by a third party, the latter must imperatively present a power of attorney in good and due form, the recipient’s identity document (or a Kbis of less than three (3) months from the recipient if it is of a legal person) as well as his own identity document. The package remains pending in the Relais Pickup for eight (8) working days from the day after its arrival. In the absence of receipt by the recipient within this period, it is automatically returned to our warehouse and the return costs are then charged to the Customer. At the Customer’s choice, the undelivered products are then either refunded to the Customer or reshipped.

ARTICLE 6: RETURNS

In accordance with articles L.221-18 and following of the Consumer Code, the Customer has a period of fourteen (14) calendar days to exercise his right of withdrawal without having to justify reasons or pay penalties to the exception, where applicable, of the cost of return. The period of fourteen calendar days runs from the date of receipt of the items. At the end of 14 calendar days, the products are considered accepted and conform to the order. In the event of a return, the item must be returned in new condition, in its original packaging. Items returned incomplete, damaged, damaged, used or soiled cannot be taken back. The return is the responsibility of the Customer. The reshipping costs of
